If someone other than the contracting party (the person signing this agreement) will be paying for the session—either partially or in full—via debit/credit card, PayPal, Venmo, or check, the name, phone number, and email address of the payee must be listed below prior to submitting payment. SHOT LIST: You may make a list of images you would like for us to try and get during your photography session. [PLEASE NOTE] Particular images or poses are NOT guaranteed. This list acts as a simple guideline for your photographer. Something Like Life Photography is not responsible for remembering or for following your shot list. It is the CLIENT'S responsibility to remember which images they would like and to work with the photographer to capture those images.

1. ENTIRE AGREEMENT: This document constitutes the full and complete agreement between SLL Photography and the CLIENT. It supersedes any and all prior agreements, understandings, or communications between the parties. Modifications or amendments to this agreement must be made in writing and executed by both parties to be enforceable.

2. COOPERATION: CLIENT agrees to provide full cooperation and clear communication with SLL Photography to facilitate the successful execution of the session. SLL Photography shall not be held liable for non-cooperation of subjects or missed images resulting from CLIENT'S failure to provide accurate information or instructions.

3. COPYRIGHT and IMAGE USAGE: All photographs created by SLL Photography are protected under Federal Copyright Law and remain the intellectual property of SLL Photography. Upon full payment, CLIENT is granted a limited license to use the images for personal purposes, including printing and sharing on personal platforms. Redistribution, alteration, or commercial use is strictly prohibited without prior written consent and compensation to SLL Photography.

4. MODEL RELEASE: SLL Photography requires express permission to use images on our social media pages, for promotional, editorial, or advertising purposes. CLIENT may withhold such permission by opting out.

This provision gives us permission to post your images on our social media pages, websites, and blogs. Any additional use and we will ask for your permission first.
5. LIMITATION of LIABILITY: SLL Photography shall not be held liable for circumstances beyond its control, including but not limited to equipment failure, acts of God, illness, or unforeseen emergencies. In the event of such occurrences, liability is strictly limited to rescheduling the session or refunding payments received.

6. PHOTOGRAPHER'S RESPONSIBILITIES: SLL Photography is responsible for punctual arrival, guidance in posing, image editing, and timely delivery of final photographs. CLIENT acknowledges that SLL Photography cannot control external factors, including weather, lighting, attire, or subject cooperation, which may affect the final results.
7. RELEASE of LIABILITY: CLIENT assumes all risks associated with the photography session and indemnifies SLL Photography against any claims for personal injury or property damage occurring during the session.

8. PROHIBITION on UNAUTHORIZED PHOTOGRAPHY: CLIENT agrees that no personal cameras, cellphones, or similar devices shall be used to capture images during the session. Violation of this policy may result in immediate termination of the session without refund.

9. ARTISTIC DISCRETION and EDITING: All packages include SLL Photography's Signature Editing Style, ensuring professional adjustments for exposure, white balance, and color correction. A black-and-white version of each image will also be provided as part of the CLIENT’S download gallery. Additional edits beyond the Signature Style may be requested; however, such edits are subject to approval and may require an additional fee. Costs for these edits range from $5 to $35 per request, depending on the complexity and time required. The CLIENT acknowledges that certain requests may not be feasible.

10. IMAGE DELIVERY TIMELINE: CLIENT agrees to allow up to eight (8) weeks for delivery of the final gallery, contingent on CLIENT'S timely image selection and submission of additional editing requests.
11. SOCIAL MEDIA and IMAGE SHARING: Clients are permitted to share images they have purchased from SLL Photography on social media and other platforms. However, clients agree not to download, screenshot, or otherwise reproduce images shared by SLL Photography on online platforms without explicit permission. Unauthorized reproduction will result in a fee equivalent to the full gallery purchase price, not exceeding $1,200.

LATE ARRIVAL POLICY: CLIENT agrees to arrive promptly for their scheduled session. If the CLIENT is more than 15 minutes late, the session may be shortened at the photographer's discretion without a reduction in fees. If the delay impacts the quality or quantity of images captured, SLL Photography will not be held liable. Additionally, if the CLIENT is more than 15 minutes late and the session cannot proceed as planned, it may be treated as a no-show, resulting in forfeiture of the retainer fee and requiring a new retainer to book a future session.

WEATHER and WIND POLICIES: Sessions may be rescheduled in cases of inclement weather at the discretion of SLL Photography. Sessions will proceed in windy conditions unless wind speeds exceed 15 mph. CLIENT is responsible for arriving prepared with appropriate attire and grooming adjustments to mitigate wind effects.

RESCHEDULING and CANCELLATION: CLIENT may reschedule their session one (1) time without penalty. Subsequent reschedules may require an additional retainer fee. Retainers are non-refundable, and cancellation by the CLIENT will result in forfeiture of the retainer.
REFUNDS: Refunds are available only in cases where dissatisfaction arises from factors within SLL Photography's control. External factors, such as weather, location, or CLIENT behavior, do not constitute grounds for a refund. The CLIENT must notify SLL Photography within 24 hours of their selection gallery being posted with any concerns or dissatisfaction. Failure to do so within this timeframe constitutes acceptance of the delivered images.
CANCELLATION, CHARGEBACKS, and REFUND POLICY: In the event the CLIENT cancels services, initiates a chargeback, or a refund is issued for any reason, the CLIENT shall be responsible for all fees, costs, and expenses incurred by or on behalf of SLL Photography in connection with such cancellation, chargeback, or refund, including but not limited to administrative fees, merchant service charges, and collection costs.

RETAINER and PAYMENT SCHEDULE: A non-refundable retainer of $150 is required at the time of booking to secure the session date. The remaining balance is due in full on the session date. The retainer fee is non-refundable except under the circumstances listed below. In all other cases, the retainer is considered liquidated damages and is non-refundable in the event of cancellation, rescheduling by the CLIENT for a second time, or breach of contract by the CLIENT.

The retainer fee is non-refundable except under the following circumstances:
1. Cancellation by SLL Photography: If SLL Photography cancels the session due to unforeseen circumstances and is unable to reschedule, the retainer will be refunded in full.
2. Reschedule Without Availability: If both parties agree that rescheduling is necessary and SLL Photography does not have any open availability to offer the client, the retainer will be refunded. However, if SLL offers a new date and/or time and the client declines the offered options and refuses to reschedule, the retainer will be nonrefundable.
3. Weather-Related or Acts of God: If the session is canceled due to severe weather conditions, natural disasters, or other acts of God that make proceeding unsafe or impractical, and a rescheduled date is not available, the retainer will be refunded. However, if SLL offers a new date and/or time and the client declines the offered options and refuses to reschedule, the retainer will be nonrefundable.
CLIENT ACKNOWLEDGEMENT: By signing this agreement, CLIENT affirms their understanding of and consent to all terms and conditions as outlined herein.
